AZRiver.com, Mustang
Communications, its owners, managers, and webmaster reserve the right
to refuse or cancel service at his or her sole discretion.
Our services may be used for
lawful purposes only. Transmission, storage, or presentation of any
information, data or material in violation of any United States Federal,
State or City law is prohibited. This includes, but is not limited to:
copyrighted material (without proper authorization), material we judge
to be threatening or obscene, or material protected by trade secret or
other statute. The user agrees to indemnify and hold harmless
AZRiver.com, Mustang Communications, its owners, managers, employees,
agents or sub-contractors harmless from any and all claims resulting
from the use of our services.
Note: Pornography and adult
themes are prohibited on any domain hosted by AZRiver.com.
This includes sites that may infer sexual content, or link to adult
content elsewhere. This is also true for sites that promote any illegal
activity or content that may be damaging to our servers or any other
server on the internet.
In addition, any site
selling or promoting Bulk email services will not allowed.
Examples of non-acceptable
content or links:
Pirated software
Hacker/Cracker programs or archives
Warez Sites
Irc Bots
Illegal Mp3's
Sub-hosting or reselling without authorization AZRiver.com et al, has sole
discretion as to what constitutes a violation of these provisions.
Bandwidth Guidelines
Each hosting plan is designed with an
ample amount of bandwidth. On average, a site with 1 Gigabyte (GB) of
bandwidth allowance can handle about 33 megabytes a day of transfers.
That works out to approximately 33,000 page views a day if you are
running a normal web site without any files for downloading. We provide
about five times that amount of bandwidth with our new basic hosting plan (VS50)
effective November 1, 2005. Any site going over the allowed amount of
data transfer will be charged additional $ 1.25 per per month
for each additional 2GB of bandwidth used and/or may be required to upgrade their
hosting account. Our most active sites currently use less than 15% of
the available bandwidth and resources offered.
High Bandwidth/Resources
Any domain or web site that
degrades the performance of our servers either by high disk usage, high
bandwidth usage, or high CPU usage will be entered into our "High
Bandwidth" list. It is at AZRiver.com's sole discretion to decide
which sites are "High Bandwidth" sites. Sites who have been
deemed as a "High Bandwidth" site will be subject to the
following in this order:
Verbal or email correspondence to resolve the high usage problem.
Additional usage fees or
mandatory account upgrade.
Deactivation of account if
action is not taken in ample amount of time.
Chat Rooms
Two types of chat rooms are now included
with each plan and can be easily configured through the web based site
control panel.
IRC
We currently do not allow
IRC or IRC bots to be operated on our servers.
CGI/Perl Scripts
Each hosting account comes with its own
secure cgi-bin directory. You are free to use
any CGI scripts you wish, however we reserve the right to disable any
CGI script that effects normal server operation. Each account control
panel includes numerous popular pre-configured scripts.
Running programs in the background
Currently we do not allow
programs to run continuously in the background. These are considered on a
case by case basis. An extra charge will be incurred based on the amount
of system resources used and the operational maintenance required.
Spam/Abuse policy
Our servers may not be the
source, intermediary, or destination address involved in the
transmission of spam, flames, email bombs, nuking or any Denial of
Service (DoS or DDoS) attack. Your domain may not be referenced as the
originator, intermediary, or reply-to address in any of the above. We
consider spam any mass unsolicited message in the mediums of Newsgroups
or Email. If you are found to have spammed, then we will immediately,
without warning, disable your domain.
Any violation of the above
abuse policy will result in immediate deactivation of services.
Anybody trying to access the shell or any other persons web site with
out permission from the systems operator, webmaster or owner of the site
is strictly prohibited. Any attempts to undermine or cause harm to a
server or hosted domain will result in immediate deactivation of
services without any refund.
Tech Support/Training
AZRiver.com and its
its owners, webmaster, operators, agents, employees and sub-contractors
do not provide any free training or tech support other than to resolve
problems with the server or actual problems with any of the services or
free scripts provided from the web site Control Panel (CPanel). It is up
to each site's webmaster to know or learn how to use the scripts or
features included with each CPanel, or how to use the cgi-bin to implement
other third-party scripts, etc.
Webmaster training is available for $65.00

documentation page has detailed information on the basics of the most
commonly used CPanel features.
We continuously update and add or remove
components from the CPanel; and so the list of features is subject to
change often. Some features may appear on the CPanel but will not function
until we have finished testing them. We will notify all hosted accounts
well in advance if we are going to remove a feature that is troublesome or
becomes insecure or in some way adversely affects server performance.
AZRiver.com will also try to provide an alternative script in the
event we have to disable or remove anything from the CPanel.
Billing/Late Fees
All hosting accounts will be billed in
January of each year. In the absence of an alternative payment
agreement/extension, or a promotional offering by Mustang Communications,
all AZRiver.com hosted customers are required to make full payment of
their hosting accounts by the last day of January, or by the final due
date listed on any invoice. Accounts that are not paid by the due date
will accrue a $35.00 late fee and an additional 3% per month penalty for
every month that the payment is not received.
Domain name renewals occur all year long
and Mustang Communications will always send out renewal notices well in
advance of any domain name expiration. New rules adopted by all domain
name registrars (ICANN) include stiff penalties for domain names that are not
renewed on time. The fee for a delinquent domain name
registration can be as high as $200. It is the responsibility of the
domain name registrant (our customers) to make sure they pay their domain name renewal to
Mustang Communications on time to avoid having to pay this penalty. In an effort to avoid our customers being
charged these delinquency fees, Mustang Communications/AZRiver.com will
automatically renew your domain name for you without prepayment. If
Mustang Communications uses this option our charge to the customer
for the domain registration will be $99.00, and this fee will be
automatically be billed to the customers account. This late charge must be
paid within 60 days in order to avoid suspension of account.
AZRiver.com/Mustang Communications highly recommends all customers prepay
their regular domain name registration fees well before the due date in
order to avoid the delinquency charges. The early bird not only gets the
worm but saves a bundle of money too.

This includes the loss of data resulting from delays, non-deliveries,
wrong delivery, and any and all service interruptions caused by
unforeseeable forces such as war, terrorism, natural disaster, or other
"acts of God"; or by the negligence of AZRiver.com/Mustang Communications, its owners, operators, agents,
employees or sub-contractors. AZRiver.com reserves the right to revise
its policies at any time without notification.
